Terms of Service
The terms that govern use of Abibo Labs apps and this website.
These Terms of Service (“Terms”) govern your access to and use of the software applications, websites, and services provided by Abibo Labs (“Abibo Labs”, “we”, “us”), including the Abibo Wishlist app (collectively, the “Services”). By installing, accessing, or using the Services, you (“you”, the “merchant”) agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must operate a valid Shopify store and have authority to bind that business to these Terms. You are responsible for activity that occurs through your store and for keeping your access credentials secure.
2. The Services
We grant you a non-exclusive, non-transferable, revocable right to use the Services for your Shopify store while you comply with these Terms. We may update, improve, or modify the Services over time. Some features are offered on free plans and others on paid plans, as described on the relevant app or pricing page.
3. Acceptable use
You agree not to: (a) use the Services unlawfully or in violation of Shopify’s terms; (b) attempt to reverse engineer, resell, or sublicense the Services except as permitted by law; (c) interfere with or disrupt the integrity or performance of the Services; (d) use the Services to store or transmit malicious code; or (e) misuse data accessed through the Services.
4. Fees and billing
Paid plans are billed through Shopify’s billing system on a recurring basis until cancelled. Prices are shown on the applicable app or pricing page and may change with reasonable notice. Except where required by law, fees are non-refundable. Cancelling removes access to paid features at the end of the current billing period.
5. Data and privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. You are responsible for maintaining your own privacy disclosures to your customers and for obtaining any consents required for the data you process through the Services.
6. Intellectual property
The Services, including all software, designs, and content we provide, are owned by Abibo Labs and protected by applicable laws. These Terms do not transfer any ownership rights to you. Feedback you provide may be used by us to improve the Services without obligation to you.
7. Third-party services
The Services operate alongside Shopify and may integrate with third-party tools. We are not responsible for third-party services, and your use of them is governed by their own terms.
8. Warranties and disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, Abibo Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the Services in the three months preceding the claim.
10. Termination
You may stop using the Services and uninstall the app at any time. We may suspend or terminate access if you breach these Terms or if required for security, legal, or operational reasons. Provisions that by their nature should survive termination will survive.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by reasonable means, and the “Last updated” date above will change. Continued use of the Services after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts located in India will have jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protections that apply to you.
